This Privacy Policy describes how ATOM LENDING CLUB CORP ("we", "us" or "our") collects, uses and discloses information in connection with your use of our mobile application Amihan Online (the "App"). We are committed to protect all personal data of Amihan Online users, including everyone who uses, visits, downloads, browses or registers for services on Amihan Online. This Privacy Policy is made in accordance with the laws of the Philippines and is for use on Amihan Online only.
We are committed to complying with the Acts of the Republic of the Philippines and the Data Privacy Act and specific implementing rules and regulations. We include ATOM LENDING CLUB CORP., its assigns, affiliates and related companies. All types of personal information described in this Privacy Policy, including sensitive personal information, are collectively referred to as “Personal Data”. Personal data is provided by the borrower when applying for a loan through Amihan Online platform. The purpose is to prevent fraud by checking the user's true identity through personal data that is collected and used solely by the Company, its assigns, affiliates and related companies.
All personal data relating to users, including names and other information, shall be processed in the manner set out in this Privacy Policy. We only collect and retain information when it is necessary for user’s transaction to the extent required by law. You can browse using Amihan Online without providing personal information. During visiting to Amihan Online, you may choose to remain anonymous and we will not be able to identify you at any time unless you log in using your Amihan Online account username and password.
The scope of this privacy policy is limited to the information we collect or receive when you use it through the Amihan Online application. We take no any responsibility for the information you provide to third-party companies , for use their services or any products.
By logging in to Amihan Online and using Amihan Online's services, which means you agree to this privacy policy and to process your personal data in the manner specified in this privacy policy. If you do not agree to these terms, please do not use and exit the Amihan Online application.

Personal Information: This may include your name, age, address, ID, username, email address, contact information, company name, company address, job type, pay date and other information that can be used to identify you.
Non-Personal Information: This may include information about your device, such as your device model, operating system and IP address. It may also include information about your use of the App, such as the features you access and the time you spend using the App, the location, photos, text messages, and call records you authorize to use.

3. When you use the app to withdraw money

1. Personal information includes name, residential address, contact number, email address, date of birth or age, gender, educational background, marital status, social account, contact information, company information, bank account information (bank card used for withdrawals) , e-wallets) and government-issued identification.
2. Non-personal information includes your device star number, operating system, IP address, usage time, device ID, MAC address, device log data and location information you authorize to use, camera photos, and APP installation list. or other information generated, collected, stored or discovered using any of Amihan Online's services.
3. Information from third parties, including employment information, biometric authentication information, text message content, call records or any financial, transaction or payment records of the user authorized by the user.
4. Anonymous, technical, network and interaction data generated or made available in accessing or using Amihan Online services.
The above information is obtained when users apply for loans and use services on Amihan Online, and this information shall be collected, used, processed, disclosed, retained, stored and protected by the company in accordance with the terms of this privacy policy.
The above information must be submitted voluntarily. We can collect your personal data only if you voluntarily submit information to us. If you choose not to submit your personal data to us or subsequently withdraw your consent to our use of your personal data, we may not be able to provide you with some or all of Amihan Online's services.
The above information needs you must submit true and accurate information to us including personal data. And when your information changes, you must promptly inform us of your latest information. We reserve the right to request documentation to verify the information you provide.
Registering an Amihan Online account, logging in and using Amihan Online services, which all means the user agrees any related information (including personal data) collected, stored, processed, used, analyzed or distributed and disclosed, and agrees provide related information to lenders and the third parties providers of services including but not limited to payment channels, credit bureaus, other third-party service providers and government agencies. The user agrees and authorizes to submit and disclose the user's basic credit data to Philippine financial institutions on a regular basis, and to share the user's basic credit data with credit reporting agencies and lending institutions recognized by Philippine financial institutions. This includes processing such information to the Bangko Sentral ng Pilipinas, Securities and Exchange Commission, Anti-Money Laundering Council, credit bureaus or any other government agency.
Lenders and other third-party service providers are required when applying for a loan for the purpose of providing services, including user profiling, identity checking and verification, fraud detection, monitoring and prevention, credit investigations, credit scoring and credit collection to obtain relevant credit Evaluate. In the course of such investigations, transactional and personal data from their employers, banks, credit card companies, retailers, telecommunications providers, IT services and other related agencies will be used to all collected user related information.
For the avoidance of doubt, User hereby acknowledges and agrees that ATOM LENDING CLUB CORP and Amihan Online's lenders can process Personal Data themselves or outsource the processing and using of such information to third party subcontractors or service providers at their sole discretion and option. Such third-party service providers, may including but are not limited to any member of ATOM LENDING CLUB CORP., its subsidiaries and affiliates, who in each case shall enter into an outsourcing agreement in accordance with the law.
For the avoidance of doubt, User hereby acknowledges and agrees that Lenders, third party subcontractors, ATOM LENDING CLUB CORP and its subsidiaries and affiliates may share all information relating to User with each other for any lawful business purpose, including but not limited to credit investigation, credit scoring, credit collection, product and system development, sales and marketing activities, communications and its products and services, etc.
We use your information for the following purposes:
1. User’s true identity identification, background investigation and identity verification;
2. Analyze user behavior or perform user profile analysis to improve products and services;
3. Provide users with new products, services and marketing information;
4. Conduct data analysis and tracking;
5. Develop and maintain risk assessment processes and models;
6. Develop and generate credit scores, credit models and user models, and conduct credit risk analysis and credit investigations;
7. Identify user credit risks, conduct and implement fraud monitoring, detection, analysis and prevention;
8. Prevent, detect and investigate actual or suspected crimes, analyze and manage business risks;
9. Provide nearby loan services through user location;
10. Quickly contact users and answer relevant questions
11. Provide and improve applications to enhance personalized user experience
12. Share your information in accordance with legal and regulatory requirements
We may share your information with third-party service providers who help us operate the App. We will only share your information with third-party service providers who agree to protect your information in accordance with this Privacy Policy.
User personal data may be disclosed to the following persons:
1. The company’s affiliates and subsidiaries, agents (including collection agencies) and subcontractors;
2. Governments, regulatory agencies and fraud prevention agencies to identify, prevent, detect or deal with fraud, money laundering or other criminal activities, or for other action with legitimate purposes;

4. Credit assessment agencies, credit bureaus, credit rating companies, fraud analysis and detection organizations and associations (public and private), and government agencies.

Third-party partners for identity verification, credit analysis and investigation, risk analysis and verification, credit scoring and credit collection, including from users’ employers, banks, credit card companies and others during such investigations relevant authorities to verify, collect and process all user related information collected from any relevant source;
6. Business partners, investors, transferees or assignees (actual or potential) to facilitate business asset transactions involving all or part of ATOM LENDING CLUB CORP (which may extend to any merger, acquisition or sale of assets or financing) enterprises;
7. Third parties engaged, used or authorized by the lender or borrower to provide any support services for the transaction (such as aggregation platforms, payment gateways, payment providers, collection agents and banks)
8. Collection and repossession agencies related to the enforcement of loan or other debt repayment obligations.
We may release your information including your personal data where permitted by law or when we believe we are required to do so by law to enforce or exercise our rights. To protect our rights, property, or safety or that of our users or others, which includes exchanging information with other companies and organizations to prevent fraud. We may share your information in the event of a merger with another company, sale of our assets, financing, or acquisition of all or a portion of our business. We may share aggregate or anonymized information about you with advertisers, publishers, business partners, sponsors and other third parties.
You have several choices regarding your information:
1. You can access and update your information in the application settings;
2. You can choose not to receive our marketing communications;
3. You can ask us to delete your information.
We will retain your information for as long as necessary to fulfill the purposes described in this privacy policy, unless a longer retention period is required or permitted by law.
The data we collect from you, including Personal Data, may be transferred to, and stored at a destination outside the Philippines. It may also be processed by employees working for us or one of our suppliers outside the Philippines. These staff members may be involved in fulfilling your request. Although we make good faith efforts to store your information in a secure operating environment that is not accessible to the public, we cannot guarantee the absolute security of that information during transmission or storage on the Amihan Online application. Additionally, while we strive to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from unlawfully accessing this information. We do not guarantee or represent that your information is lost or misused or altered by third parties.
If you need to modify, delete, or update your personal data, you can contact us through the customer service within the Amihan Online application. When contacting us, you are required to provide your true identity information.
We may update this privacy policy from time to time. We will notify you of any changes by posting the new Privacy Policy on the App.
